Terms and Conditions
This agreement is between Gulfnet Intl. Co. W.L.L. - KEMS (First Party) and the subscriber (Second Party) for one month or more unless terminated as per the conditions listed in this agreement or by order of the MOC, without any refund.
The second party agrees to use this service for home use only. If First Party detects miss use of the service by Second Party by and not limited to connecting to local networks, International Networks, commercial use or reselling the service with or without charges or distributing it among residential buildings or flats.
The second party agrees that their computers will not be used for hacking or illegal/unauthorized access to other computers. Additionally, the second party agrees that no applications should be utilized on their personal computers which may affect the service performance in general.
The second party agrees not to use the service to operate internet telephony communication services VoIP.
The second party agrees that all copyrights laws pertaining to copyright material as required by the laws of state of Kuwait will not be violated using the first party services. Both parties should adhere regulations that might be issued to organize the internet services in the State of Kuwait.
Payment for Internet Services has to be made in advance. Failure to pay will result in suspension of accounts. Moreover, the second party information will be completely deleted and all service connections will be removed after two months suspension without renewal.
Second Party agrees that passwords are confidential and to keep their access password protected from other.
All purchased equipment’s by the Second Party from the First Party shall neither returnable nor exchangeable in any situation. The equipment’s shall have three-months manufacturing warranty from the date of purchase. D-link 2730u model carry six-months warranty, Buffalo devices shall have three-years manufacturing warranty and TP-Link devices shall have one-year manufacturing warranty. The Warranty shall not cover the accessories i.e. power adaptor or misusage etc.
If the second party desires a site installation it will be provided by the first party for 10 K.D. while site technical support will be charged 20 K.D fee in advance.
Cancellation fee mentioned in the invoice is charged when contract is canceled before expiry date as well as the original invoice should be shown upon cancellation. Service reallocation fee 10 K.D. and the setup charge for new subscriptions 5 K.D. is nonrefundable at any case. Connections will be removed in 10 business days after cancellation.
The second party must change his/her password within 24 hours of provision of service by http://www.kems.net.
The Second Party agrees that Internet Service is not a secure service for any financial transaction and First Party shall not be responsible in case of any financial loses.
The First party has the right to increase or decrease the prices upon contract expiry without any objection from the second party.
The first party is not responsible for any technical factors delaying providing the service for the second party or any external factors which may affect the quality of the service.
The second party agrees on any regulations or conditions to be set by the first party in the future. Any proposed offer cannot be used in conjunction with other offers.
